By accessing or using this website and any related websites operated by Shifting Tides, LLC, including ToddSnyderCoaching.com (collectively, the “Site”), you agree to these Terms of Use and all applicable laws. If you do not agree, please do not use the Site.

Important Disclaimer: Coaching Is Not Therapy or Professional Advice

The services and content offered through the Site are coaching, educational, and informational in nature. They are not psychotherapy, counseling, mental health treatment, medical care, or any other licensed professional service, and they are not a substitute for them.

Todd Snyder is a licensed clinical psychologist, but the coaching and consulting services offered through the Site are provided in a coaching capacity only. Using the Site or engaging our coaching services does not create a psychologist-patient, therapist-client, or any other licensed professional relationship, and does not establish the confidentiality protections that apply to licensed clinical care.

Nothing on the Site is medical, psychological, legal, or financial advice. You should consult a qualified licensed professional before making decisions related to your health, mental health, legal, or financial situation.

No Guarantee of Results or Earnings

We do not guarantee any particular result from using the Site or our services. Coaching outcomes depend on many factors that are specific to you, including your own effort, decisions, skills, resources, and circumstances. Any examples of results are not promises or guarantees of your results.

Where the Site discusses business or financial topics, we make no representation or guarantee that you will earn any particular amount of money or achieve any particular business result. You are solely responsible for your own decisions, your own business, and evaluating your own potential. Your results depend on your own ideas, execution, effort, finances, knowledge, and skill, which differ from person to person.

Testimonials

The Site may include testimonials from clients or customers. These reflect the individual experiences of those people. They are not a guarantee that you or anyone else will achieve the same or similar results. Individual results vary and depend on the factors described above. Testimonials are not necessarily representative of all clients.

Relationship to Other Agreements

These Terms of Use govern your access to and use of the Site. If you enter into a separate written coaching, consulting, or services agreement with us, that signed agreement governs those services and controls over these Terms of Use to the extent they conflict with respect to those services. These Terms of Use do not replace, reduce, or override any separate signed agreement between you and the Company.

Intellectual Property and Content

The Site and all content made available on it by us or our third-party providers, including videos, training materials, products, services, text, graphics, photos, artwork, documents, code (HTML, CSS, JavaScript), audio, and the overall look and feel (collectively, the “Content”), are owned by the Company or its providers and are protected by copyright, trademark, and other laws. The Content is provided for your personal, non-commercial use.

Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and view the Site and the Content for your personal use. You may not copy, reproduce, republish, upload, post, transmit, distribute, modify, or use any Content for public or commercial purposes without our express written permission. Unauthorized use may violate copyright, trademark, privacy, publicity, and other laws and may result in liability.

All trade names, trademarks, and images of people used in the Content are the property of, or used with permission by, the Company. Nothing on the Site grants you any license or right to use any trademark or other proprietary information without the written consent of the owner.

If you believe your intellectual property rights have been infringed on the Site, please notify us at [email protected] with your name and contact information, a description of the work and how it is being infringed, the location (URL) of the material, and any relevant registration information. We may, but are not obligated to, remove content we deem in our sole discretion to be unlawful or to infringe the rights of others.

Your Submissions and Feedback

If you send us comments, suggestions, ideas, or other materials about the Site, those submissions are not confidential, and they become the property of the Company. We may use them for any purpose, commercial or otherwise, without compensation or acknowledgment to you. Do not send us anything you consider confidential or proprietary.

Purchases, Payment, and Refunds

If you purchase a product, program, or service through the Site, you agree to pay all applicable fees. Payments are processed by Stripe, and you authorize us and Stripe to charge your selected payment method for the amounts due.

Text Messages (SMS)

We use text messages to confirm appointments and send appointment reminders. By providing your mobile phone number, you consent to receive these transactional text messages. Message frequency varies, and message and data rates may apply. You can reply STOP to opt out at any time and HELP for help. Consent to receive text messages is not a condition of purchase. See our Privacy Policy for more detail on how we handle your mobile information.

Electronic Communications

When you register or interact with the Site, you consent to receive notices, disclosures, agreements, and other communications from us electronically, including by email and, where you have provided your number, by text message. You agree that electronic communications satisfy any legal requirement that a communication be in writing.

Accuracy of Information

We use reasonable efforts to keep the information on the Site accurate and up to date, but we make no warranty as to its accuracy and assume no liability for any errors or omissions in the Content.

Security

We use commercially reasonable efforts to restrict unauthorized access to our data and files. No system is completely secure, however, and you acknowledge that unauthorized third parties may be able to access, view, copy, or distribute data you store using the Site. You use the Site at your own risk.

Privacy

Your use of the Site is also governed by our Privacy Policy, available from the footer of www.toddsnydercoaching.com. By using the Site, you accept the Privacy Policy. If you do not agree with it, please do not use the Site.

Disclaimer of Warranties

To the fullest extent permitted by law, the Site and all Content are provided “as is” and “as available,” without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, in no event shall the Company or anyone involved in creating, producing, or maintaining the Site be liable for any direct, indirect, incidental, special, punitive, reliance, or consequential damages arising out of or relating to your access to or use of the Site or Content, including loss of profits, revenue, data, goodwill, or other intangible losses, regardless of the theory of liability and even if we have been advised of the possibility of such damages.

Third-Party Services

We are not responsible for performance or service problems caused by any third-party website or service provider, including your internet service provider, Stripe, the Kajabi platform, or your own software. Any such problem is governed solely by your agreement with that provider. We reserve the right to limit your use of the Site or to terminate your account if we determine you have violated these Terms of Use, and to refuse access to the Site or our products and services in our discretion.

Indemnification

You agree to indemnify and hold harmless the Company and its directors, officers, employees, and agents from any claims, liabilities, damages, and expenses, including reasonable attorneys’ fees, arising out of or relating to: (i) your breach of these Terms of Use; (ii) your violation of any law or the rights of any third party; (iii) any content you post or share on or through the Site; (iv) your use of the Site or any services we provide through it; and (v) your conduct in connection with the Site or other users. We may assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate with us.

Benefit of Provisions

These Terms of Use are for the benefit of the Company and its subsidiaries, affiliates, and third-party content providers and licensors, each of which may enforce these provisions directly.

Governing Law and Jurisdiction

These Terms of Use are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Porter County, Indiana for any dispute arising out of or relating to the Site or these Terms of Use.

Changes to These Terms

We may revise these Terms of Use from time to time by posting an updated version on this page and revising the “Effective date” above. Your continued use of the Site after a change means you accept the updated Terms of Use. We encourage you to review this page periodically.

Severability and Entire Agreement

If any provision of these Terms of Use is found unlawful or unenforceable, that provision will be severed and the remaining provisions will stay in effect. These Terms of Use, together with our Privacy Policy, are the entire agreement between you and the Company regarding your use of the Site. They do not override any separate signed coaching, consulting, or services agreement between you and the Company, which controls with respect to those services.

Shifting Tides, LLC (“the Company,” “we,” “us,” or “our”) respects the privacy of visitors to its website,

www.toddsnydercoaching.com and the services offered through it (the “Site”). This Privacy Policy explains what information we collect when you use the Site, how we use it, who we share it with, and the choices you have.

This policy covers your use of the Site only. It does not cover any separate coaching, consulting, or other professional engagement you may enter into with us. Those engagements are governed by the separate written agreement you sign for those services, which sets its own confidentiality terms. If you have not signed a separate services agreement, this policy applies to your interactions with the Site, including newsletter sign-ups, scheduling, downloads, and purchases.

Information We Collect

Information you give us

When you fill out a form, subscribe to our mailing list, request information, schedule a call, download a resource, or make a purchase, we may collect:

     Contact details such as your name, email address, mailing address, and phone number;

     Demographic or preference information you choose to provide;

     Messages and information you send us by email, web form, or scheduling tool;

     Purchase information processed through Stripe (we receive confirmation and transaction details, not your full card number).

Information collected automatically

When you visit the Site, our servers and the tools described below automatically collect certain non-identifying technical information, including your IP address, browser type, device type, operating system, referring pages, and the pages you view. We use this information to operate, secure, and improve the Site.

Cookies and Tracking Technologies

Cookies are small files placed on your device that help a website function and remember your preferences. We and our service providers use cookies and similar technologies on the Site for the following purposes:

     Essential and functional cookies (Kajabi): required for the Site to work, to keep you logged in, and to remember your settings. The Site may not function properly without these.

     Analytics (Google Analytics): we use Google Analytics to understand how visitors find and use the Site. Google Analytics uses cookies and similar identifiers to collect information such as your IP address, device and browser details, and the pages you view. This helps us measure traffic and improve content. You can learn how Google uses this data at https://policies.google.com/privacy, and you can opt out using the Google Analytics Opt-out Browser Add-on at https://tools.google.com/dlpage/gaoptout.

     Advertising and retargeting (Meta Pixel): we use the Meta Pixel from Meta Platforms, Inc. (Facebook and Instagram). The Meta Pixel uses cookies and similar technologies to record your activity on the Site so that we can show you relevant ads on Meta platforms and measure how those ads perform. This means Meta may receive information about your visit to the Site. You can manage your ad preferences in your Facebook and Instagram settings, and through the Digital Advertising Alliance opt-out tool at https://optout.aboutads.info.

Most browsers accept cookies by default. You can set your browser to refuse cookies or to alert you when a cookie is being sent. If you disable cookies, some parts of the Site may not work properly. Where required by law, we display a cookie consent banner and ask for your consent before placing non-essential (analytics and advertising) cookies.

Do Not Track and Global Privacy Control: some browsers and extensions can send a Global Privacy Control (GPC) or similar opt-out preference signal. Where required by applicable law, we treat a recognized GPC signal as a valid request to opt out of the “sale” or “sharing” of personal information for that browser.

How We Use Your Information

We use the information we collect to:

     Provide, operate, secure, and improve the Site and our services;

     Respond to your inquiries and provide customer support;

     Schedule and confirm appointments and send appointment reminders;

     Process and fulfill purchases through Stripe;

     Send you newsletters, offers, and other marketing communications where you have opted in, from which you can unsubscribe at any time;

     Understand how the Site is used and measure the performance of our content and advertising;

     Comply with our legal obligations and enforce our Terms of Use.

How We Share Your Information

We do not sell your personal information for money. We share personal information only as described here:

     Service providers: with companies that perform services for us, such as Kajabi (hosting), Stripe (payments), Google (analytics), Meta (advertising), and our email and SMS providers. These providers may use your information only to provide services to us.

     Advertising and analytics partners: our use of the Meta Pixel and Google Analytics allows those companies to collect information about your activity on the Site. Under some state privacy laws, this kind of activity may be considered a “sale” or “sharing” of personal information, even though we receive no money for it. You can opt out as described in the “Cookies and Tracking Technologies” and “Your Privacy Rights” sections.

     Legal and safety: when we believe in good faith that disclosure is necessary to comply with the law, respond to lawful requests by public authorities, enforce our Terms of Use, or protect the rights, property, or safety of the Company, our users, or others.

     Business transfers: in connection with a merger, acquisition, financing, or sale of all or part of our business, in which case personal information may be transferred as a business asset.

Information you submit through email inquiries is used only to respond to your inquiry in the ordinary course of business and is not shared with third parties for their own marketing.

Text Messages (SMS)

We use text messages only to confirm appointments and to send appointment reminders. By giving us your mobile phone number, you agree that we may send you these transactional text messages.

     Message frequency varies based on your appointments. Message and data rates may apply.

     Reply STOP at any time to opt out of text messages. Reply HELP for help.

     Consent to receive text messages is not a condition of purchasing any product or service.

     We do not sell or share your mobile phone number or your text-messaging consent with third parties or affiliates for their own marketing purposes. Mobile opt-in information is not shared with the advertising partners described above.

Your wireless carrier is not liable for delayed or undelivered messages.

Email Communications and Opt-Out

If you have opted in to receive marketing emails, you can unsubscribe at any time by following the unsubscribe instructions in any such email. If you are unable to unsubscribe, email us at [email protected] and ask to be removed from the mailing list. We will still send you non-marketing messages related to your account, purchases, or appointments.

Your Privacy Rights

Depending on where you live, you may have the right to request access to the personal information we hold about you, ask us to correct or delete it, and opt out of certain uses such as targeted advertising. To exercise any of these rights, email us at [email protected] with a clear description of your request (for example, “Access Request,” “Delete My Information,” or “Opt Out of Targeted Advertising”). We will respond within the time required by applicable law. We will not discriminate against you for exercising these rights.

California residents: under the California Consumer Privacy Act, as amended, you have the rights described above, including the right to know what personal information we collect, the right to delete it, the right to correct it, and the right to opt out of the “sale” or “sharing” of personal information. As noted above, our use of advertising and analytics tools may be treated as “sharing.” You can opt out by using the cookie controls on the Site, sending a Global Privacy Control signal, or emailing us. We do not sell personal information for money and do not knowingly sell or share the personal information of anyone under 16.

Other U.S. state residents: if you live in a state with a comprehensive consumer privacy law (such as Indiana, whose law takes effect January 1, 2026), you may have similar rights. You can exercise them using the same contact information above.

Children’s Privacy

The Site and our services are intended for adults and are not directed to children. We do not knowingly collect personal information from children under 13. If you are under 13, please do not submit any personal information to the Site. If we learn that we have collected personal information from a child under 13, we will delete it. We encourage parents to supervise their children’s online activity.

Data Retention

When information is no longer needed, we take reasonable steps to delete or de-identify it.

The Site is operated in the United States and our service providers may store and process information in the United States and other countries. If you access the Site from outside the United States, you understand that your information may be transferred to and processed in the United States, where data protection laws may differ from those in your country.
